These Terms of Service ("Terms") govern your use of EchoTune ("the App"), provided by EchoTune Software ("we", "us", or "our"). By downloading, installing, or using EchoTune, you agree to these Terms.
1. License Grant
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use EchoTune on devices you own or control, in accordance with your license tier:
- Free Trial: 7-day full access to all features
- Individual License: One (1) Mac device
- Team License: Three (3) Mac devices
2. Restrictions
You may not:
- Copy, modify, or distribute the App
- Reverse engineer, decompile, or disassemble the App
- Remove or alter any proprietary notices
- Use the App for any illegal purpose
- Share, sell, or transfer your license to others (except as permitted for Team licenses)
- Use the App in a way that infringes on others' rights
3. Purchases and Payments
3.1 Direct Purchases
Purchases made through our website are processed by secure third-party payment processors. We do not store your payment information.
3.2 App Store Purchases
Purchases made through the Mac App Store are governed by Apple's terms and conditions. Refunds for App Store purchases must be requested through Apple.
3.3 Refund Policy
For direct purchases, we offer a 14-day money-back guarantee. If you're not satisfied with EchoTune, contact us at support@echotune.app for a full refund.
4. Free Trial
The free trial provides full access to all features for 7 days. No payment information is required. After the trial period, you may purchase a license to continue using EchoTune.
5. Third-Party Services
EchoTune may integrate with third-party services (Groq, Deepgram, OpenAI, Anthropic). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the content, privacy practices, or availability of these services.
6. Intellectual Property
EchoTune, including its design, features, and code, is protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted in these Terms are reserved.
7. Your Content
You retain all rights to your audio recordings and transcriptions. EchoTune does not claim any ownership over your content. We do not access, view, or store your content (see our Privacy Policy).
8. Disclaimer of Warranties
ECHOTUNE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF HARMFUL COMPONENTS.
Transcription accuracy depends on audio quality, ambient noise, accents, and other factors. We do not guarantee 100% accuracy.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF ECHOTUNE.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP.
10. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of EchoTune or violation of these Terms.
11. Updates
We may release updates to EchoTune from time to time. Your license includes free updates for the major version you purchased (e.g., version 1.x). Major version upgrades may require an additional purchase.
12. Termination
We may terminate your license if you violate these Terms. Upon termination, you must stop using and delete all copies of EchoTune.
13. Governing Law
These Terms are governed by the laws of the United Kingdom, without regard to conflict of law principles.
14. Changes to Terms
We may update these Terms from time to time. We will notify you of significant changes through the App or our website. Continued use of EchoTune after changes constitutes acceptance of the new Terms.
